Zenith Energy states that its subsidiary Canadian North Africa Oil and Gas has submitted what the company describes as new and compelling evidence to Switzerland's Supreme Court in its application to invalidate the ICC-2 arbitration award against Tunisia. This is according to a press release.According to Zenith, the material shows a previously undisclosed relationship between the law firm that represented Tunisia and the chair of the arbitral tribunal, Cecilia Carrara. The company believes this raises questions about the arbitral tribunal's independence and impartiality. Zenith also states that the material will be submitted to courts and criminal investigation authorities in several jurisdictions. The company has also instructed its legal advisers to prepare an application to the European Court of Human Rights if necessary.The dispute concerns an ICC arbitration award linked to the former SLK concession in Tunisia. Zenith's subsidiary has previously sought around USD 130 million in damages and applied for the award to be invalidated, citing alleged procedural irregularities.
